BOARD OF COUNTY COMMISSIONERS

KLAMATH COUNTY, OREGON

IN THE MATTER OF AN EXPANSION ) OF THE BOUNDARY OF THE ) RESOLUTION NO.___________ KLAMATH FALLS/KLAMATH COUNTY )ENTERPRISE ZONE )_____________________________________

Whereas, the City of Klamath Falls and Klamath County successfully applied for an enterprise zone, which was designated the Klamath Falls/Klamath County Enterprise Zone by the Director of the Oregon Economic and Community Development Department; and

Whereas, the designation of an enterprise zone does not grant or imply permission to develop land within the Zone without complying with all prevailing zoning, regulatory and permitting processes and restrictions of any and all local jurisdictions; nor does it indicate any public intent to modify those processes or restrictions, unless otherwise in agreement with applicable comprehensive land use plans; and

Whereas, this Enterprise Zone and the property tax exemption that it offers for new investments in plant and equipment by eligible business firms are critical elements of local efforts to increase employment opportunities, to raise local incomes, to attract investments by new and existing businesses and to secure and diversify the local economic base; and

Whereas, the Board of County Commissioners is agreed in requesting a change to the boundary of the Klamath Falls/Klamath County Enterprise Zone that would add the areas indicated in the attached map (Exhibit A) and legal descriptions (Exhibits B and C), such that the amended Enterprise Zone would be configured according to the attached map and descriptions (Exhibits A-C); and

Whereas, a public meeting was held in Klamath Falls on February 24, 2005, to hear the response of the citizenry to the proposed change in the Klamath Falls/Klamath County Enterprise Zone requested herein, and the Board of County Commissioners approved the boundary change in accordance with Exhibits A-C; and

Whereas, special notification was sent to the taxing districts that the zone will newly contain.

 

NOW, THEREFORE IT IS HEREBY RESOLVED THAT:

  1. The Board of Klamath County Commissioners will request a change in the boundary of the Klamath Falls/Klamath County Enterprise Zone as shown in the attached map and legal descriptions (Exhibits A-C).
  2. Heather Marlow, the local Zone Manager, is hereby authorized to prepare and submit technical memoranda to the Oregon Economic and Community Development Department, along with this resolution and other necessary documents, verifying that the requested boundary change to the Klamath Falls/Klamath County Enterprise Zone complies with the requirements of ORS 285C.115, so that the request herein may be approved by the department’s Director.
